Terms of Trade

  1. Definitions.  In these terms and conditions, ‘The Client’ means the person, firm or company making the booking, and ‘the Booking’ means the function to be catered for by Kitchen Secrets for the Client; and ‘the Quotation’ means Kitchen Secrets’s Quotation of price based on the estimated number of persons who will be attending the booking.
  2. Quotation.  A Quotation is valid for three months from the date thereof unless otherwise stated.
  3. Confirmations.  All Bookings must be confirmed in writing by the Client.  The Client’s signature will confirm acceptance both of the Quotation and of these Terms and Conditions.
  4. Numbers.  All prices quoted are for a specific number of guests, and any change in numbers will affect the overall price.  Confirmation of final minimum numbers must be given five working days prior to the date of the event.  After that time, the Client will be charged for the number of persons on the Quotation as a minimum.
  5. Payments. Full payments to be received on booking.
  6. Refunds. If cancellation is in compliance with the terms set out in Schedule 1 there will be a full refund. Refer to Schedule 1 for further cancellation policies and their respective refundable policies.
  7. VAT. As Kitchen Secrets is currently registered as a new Sole Trader there is no VAT charge.
  8. Third party arrangements.  When a function is arranged on behalf of the Client, by  a third party, written proof of payment must be provided to Kitchen Secrets before the Booking is confirmed.
  9. Cancellation.  If a booking is cancelled after confirmation by the Client, any liability to sub contractors or other costs or expenses incurred by Kitchen Secrets on behalf of the Client will be charged to the Client.
    In the event of the cancellation of an event, the following percentage of the cost will be charged to the Client:
    Cancellation within 5 days of the event– 0% of quoted cost
    Cancellation within 48 hours of the event – 50% of quoted cost.
    Cancellation within 25 hours of the event – 100% of quoted cost.
  10. Variations.  The contents of menus, ingredients, wine, or any other items Kitchen Secrets shall supply are subject to market availability.  Any alteration will be notified to the client.
  11. Food.  Kitchen Secrets cannot be held responsible for the safety of any food supplied directly by the client.
  12. Personal Belongings.  Kitchen Secrets does not accept responsibility for guest’s possessions.
  13. Personal Injury. The Client shall employ reasonable care not to inflict injury or damage on themselves or a fellow participant and their belongings. Kitchen Secrets shall be under no liability for loss, injury or damage to property whether in respect of any neglect, act of omission by us or otherwise.
  14. Standard of Behaviour. Clients are expected to behave sensibly and appropriately at all times. If for any reason we are unhappy with your behaviour Kitchen Secrets reserve the right to end the event or demand the client to cease participation in the event.
  15. Alcohol. Alcohol shall in compliance with UK Law only be served to clients over the age of 18.
  16. Allergies and Dietary Requirements. The client is bound to advise Kitchen Secrets of any allergies or special requirements needed with one weeks notice prior to the event to enable appropriate action to be taken. In the event of a serious, health threatening allergy the client participates at their own risk. Although all steps will be taken to decrease contamination Kitchen Secrets can grant no guarantee for the ingredients used and therefore will not be held Liable for any consequences arising form an allergic reaction.
  17. Loss or Damage.  The Client is wholly responsible for all equipment from the time of delivery until it is collected.  Any breakage, loss or damage, however caused, will be charged to the Client at the full replacement cost. 
    The Client will be responsible for and will indemnify Kitchen Secrets fully against all claims, costs, loss, damage or liability arising due to the act, neglect or default of the Client or of any person for whom the Client is responsible.
  18. Force Majeure.  No liability is accepted for failure of performance due to strike, lockout, accidents, fire, floods, ice, obstruction or other such events beyond the control of Kitchen Secrets.
  19. Limitation of liability.  No liability is accepted for loss, damage or consequential loss caused by Kitchen Secret’s failure to perform its obligations (whether that failure is due to negligence on the part of the company, its officers, employees or sub-contractors or due to other causes).
  20. Law of the contract.  The contract which incorporates these Terms and Conditions shall be governed by British law and the parties agree to submit to the exclusive jurisdiction of the English courts.
  21. Complaints.  Any complaint must be made verbally within 24 hours of the event concerned and followed in writing not more than 48 hours after the event date.  Where after it shall be deemed to be unjustified.
